1. SCOPE OF APPLICATION

These General Terms and Conditions of Sale (hereinafter, the General Terms) apply to any purchase of goods or products (hereinafter, the Products) made on this Website (https://www.tinyriots.es/) owned by ESCURA BABY FOOD, S.L. (hereinafter, "Tiny Riots"), with registered address at Calle Comte d'Urgell n.º 240 - P. 7 PTA. B, (08036), Barcelona and Tax ID B75608091.

These General Terms may be modified at any time. It is therefore recommended that the Customer consults them each time they browse or intend to purchase the Subscription Service through the Website, as the version in force at the time of purchase will apply.


2. SERVICES OFFERED THROUGH THIS WEBSITE

Tiny Riots sells its products through the following services:

2.1 Subscription Service

2.1.1 How to activate the Subscription Service

To activate the Tiny Riots Subscription Service, the Customer must follow these steps:

  1. The Customer must register on the Website to activate the Subscription Service.
  2. To register as a Customer, they must provide a username, email address and password.
  3. The Customer must provide the following details so that Tiny Riots can deliver the Products included in the Subscription Service: full name, address, postcode, city, email address and contact phone number. This data will be stored in Tiny Riots' database and will only be accessible to authorised personnel. If the Customer notices an error in their personal data during registration, they may update it in the "My Account" section. In any case, the Customer may correct errors related to personal data provided during the purchase process by contacting customer service by phone or email. If the Customer notices an error after completing the payment process, they must contact customer service immediately to correct it.
  4. The Customer must then choose how many products are included in the Subscription Service. The minimum order is eight (8) products.
  5. If available, the Customer may enter discount codes or vouchers to reduce the final price of the shopping cart.
  6. Once the Customer has expressly accepted the General Terms and entered their delivery details, they may proceed to payment.

2.1.2 Availability and liability

Tiny Riots guarantees the availability of all products published on its website as part of the Subscription Service.

Tiny Riots shall not be liable for delays in the delivery of orders or for the impossibility of delivering them when the cause is due to force majeure events. Force majeure events include, among others: accidents, strikes, fires, weather conditions, natural disasters such as storms, earthquakes, epidemics, and transport or telecommunications system failures.

Tiny Riots' liability in relation to any product forming part of the Subscription Service shall be strictly limited to the price of that product.


2.2 Direct Product Sales

2.2.1 How to place an order

To purchase any Tiny Riots Products, the Customer must follow these steps:

  1. The Customer may register on the Website to purchase Products or, alternatively, purchase as a guest.
  2. If registering as a Customer, they must provide an email address and password.
  3. To place an order, the Customer must select the Products they wish to purchase, which will be added to the shopping cart. Once all Products have been selected, if they wish to proceed, they must select a delivery date and click "Pay for Order".
  4. The Customer must then choose the number of products in the order. The minimum order is eight (8) products.
  5. The Customer must provide the following details so that Tiny Riots can deliver the Products: full name, address, postcode, city, email address and contact phone number. This data will be stored in Tiny Riots' database and will only be accessible to authorised personnel. If a registered Customer notices an error in their personal data, they may update it in the "My Account" section. The Customer may also correct errors related to personal data provided during the purchase process by contacting customer service by phone or email. If the Customer notices an error after completing the payment process, they must contact customer service immediately to correct it.
  6. If available, the Customer may enter discount codes or vouchers to reduce the final price of the shopping cart.
  7. Once the Customer has expressly accepted the General Terms and entered their delivery details, they may proceed to payment.

2.3 Availability and liability

Tiny Riots guarantees the availability of all products published on its website.

3. PRODUCT INFORMATION

Tiny Riots is committed and has taken the necessary steps to ensure that the images displayed on the Website are as accurate as possible to the original products, so as not to mislead the Customer.

However, Tiny Riots cannot guarantee that the display of colours or other details as seen through the Customer's device accurately reflects the characteristics or colours of the product received, as this will depend on the resolution of their device.


4. PRICING AND PAYMENT

4.1 Subscription Service

4.1.1 Subscription Service pricing

The price of the Subscription Service on the Website depends on the number of products chosen by the Customer. In all cases, the price is shown in euros and includes applicable taxes, including Value Added Tax (VAT).

Tiny Riots reserves the right to modify the price of the Subscription Service offered through the Website.

To ensure pricing certainty for the Customer, the price applicable will be the one in force at the time of activating the Subscription Service and, where applicable, at the time of renewal.

The following discounts apply when purchasing products through the Subscription Service:

  • Subscription Service purchase: a 10% discount will apply.
  • Selection of a minimum of 12 products: a 15% discount will apply. This discount is not cumulative with the previous one, but is an alternative to it.
  • Selection of a minimum of 18 products: the 15% discount mentioned above will apply and, additionally, no shipping costs will be charged, except for the surcharge for delivery to remote areas (section 5.2 of these General Terms).

In all cases, the price of the Subscription Service does not include the cost of shipping the products, which will be itemised before completing payment.

4.1.2 Payment

To activate the Subscription Service, the Customer may use the following payment methods:

  • Debit/credit card: the Customer must follow the on-screen instructions, providing the card number, type, security code and cardholder name. Tiny Riots uses the Comercia Global Payments service, which incorporates SSL security, so that confidential card details are transmitted in encrypted form to the bank's server and are not stored on Tiny Riots' server.
  • Shop Pay: the Customer may complete payment through their Shopify account. If this payment method is selected, the Customer will be redirected to the Shopify page to log in with their username and password.
  • Google Pay: the Customer may complete payment through their Google account. If this payment method is selected, the Customer will be redirected to the Google page to log in with their username and password.

The Subscription Service is activated via the "BUY" button on the Website, once the General Terms have been expressly accepted.

4.1.3 Invoicing

Tiny Riots will send the Customer, within a maximum of 24 hours, an order confirmation with all its terms to the email address provided.

The Customer will receive a paper invoice with their Products. If an electronic invoice is required, this must be indicated at the time of placing the order.


4.2 Direct Product Sales

4.2.1 Product pricing

The price of products offered individually on the Website is shown in euros and includes applicable taxes, including Value Added Tax (VAT). Tiny Riots reserves the right to modify the price of products offered through the Website. To ensure pricing certainty for the Customer, the price applicable will be the one in force at the time of placing the order.

The price of the Products does not include the cost of shipping, which will be itemised before completing payment.

4.2.2 Payment

For direct product purchases, the Customer may use the following payment methods:

  • Debit/credit card: the Customer must follow the on-screen instructions, providing the card number, type, security code and cardholder name. Products are purchased via the "BUY" button on the Website, once the General Terms have been expressly accepted.

4.2.3 Invoicing

Tiny Riots will send the Customer, within a maximum of 24 hours, an order confirmation with all its terms to the email address provided.

The Customer will receive a paper invoice with their Products. If an electronic invoice is required, this must be indicated at the time of placing the order.


5. SHIPPING

5.1 Delivery time

For the purposes of these General Terms, "delivery" shall be understood to have taken place, or the Products shall be considered "delivered", at the moment the Customer or a third party designated by them takes physical possession of the Products.

Deliveries are made to the address provided by the Customer when activating the Subscription Service.

Regarding delivery times, orders will be delivered within a maximum of twenty-four (24) hours from receipt by the carrier.

The carrier will deliver the order to the delivery address designated by the Customer. If the Customer is not present at the designated location at the time of delivery, the carrier will hold the order and make a second delivery attempt on the next business day, except during peak production periods for the carrier.

If the Customer is not present at the designated location at the time of the second delivery attempt — or, where applicable, after the first delivery attempt during carrier peak production periods — the order will be destroyed, and the Customer will lose the right to receive the Order as well as any form of compensation. Likewise, no credit or refund will be issued under any circumstances for an undelivered order where the failure to deliver is solely attributable to the Customer.

Orders will not be delivered on Mondays or public holidays.

If for any reason Tiny Riots is unable to meet the expected delivery date, the Customer will be informed and delivery will take place on the immediately following day.

To ensure correct receipt of the product and to maintain the cold chain, please note that Tiny Riots only ships within mainland Spain and the Balearic Islands, ensuring that the product is always delivered in the best possible conditions.

5.2 Shipping costs

Tiny Riots will charge the following amounts for shipping:

  • A flat rate of €5.99 per shipment will apply.
  • For remote or hard-to-access areas, a surcharge of €3.30 per shipment will apply.

In all cases, the shipping costs will be displayed at the time of placing the order and entering the delivery address.


6. DURATION, MODIFICATION, RENEWAL AND CANCELLATION OF THE SUBSCRIPTION SERVICE

The Subscription Service is a fortnightly service, which renews automatically for the same period (fortnightly), unless the Customer cancels it. The Customer may pause or cancel the subscription up to three (3) days before the shipment date, which is when payment will be processed.

The Customer may also modify the products, as well as the delivery date or location, up to that same date.

If the Customer does not cancel the subscription, it will be automatically processed and charged every fifteen (15) days for the dispatch of the order.

If the payment method is declined, a second payment attempt will be made on the following calendar day. If this second attempt is also declined, the shipment will be cancelled.


7. RIGHT OF WITHDRAWAL

Regarding the Tiny Riots Subscription Service, in accordance with article 103.d of Royal Legislative Decree 1/2007 of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users, please note that the right of withdrawal does not apply, as the products supplied may deteriorate or expire quickly.

Furthermore, given the nature of the products supplied — both as part of the Subscription Service and those purchased individually — the Customer is informed that order cancellations will not be accepted within fifty-two (52) hours before payment is processed.

7.1 REFUNDS

Tiny Riots will only issue a refund in cases where there is direct liability on the part of the company, that is, when the delivery failure is solely and exclusively attributable to the company, or when the products delivered are in poor condition due to a handling error on the part of the company, and not due to improper storage by the Customer. Refunds will be limited to the price of the products in poor condition, not the total order amount.

In this regard, the Customer may choose between a proportional reduction of the subscription price already paid or, where applicable, a reduction in the price of the next subscription.

Only in cases where the Customer has received the product and finds that it is not in optimal condition may they contact Tiny Riots through the contact form or via the following email address: hola@tinyriots.es

The Customer must report the issue within a maximum of twenty-four (24) hours of receiving the product and provide images (of the product, packaging and labelling) that evidence the situation, indicating the issue observed. Tiny Riots may request additional information in order to verify the incident and analyse what occurred.


8. INTELLECTUAL AND INDUSTRIAL PROPERTY

All content displayed on the Website, including in particular designs, texts, graphics, images, databases, software, sounds, trademarks, logos or any other signs capable of industrial and commercial use, are subject to the intellectual and industrial property rights of Tiny Riots or of duly authorised third parties.

Access to and/or use of the Website does not in any case imply any waiver, transfer, licence or total or partial assignment of such rights, nor does it confer any right or expectation, in particular to alter, exploit, reproduce, distribute or publicly communicate such content, without the prior express authorisation of Tiny Riots or the relevant rights holders.

No link to the Website may be established from any other website without the prior express consent of Tiny Riots.


9. RESPONSIBLE CONSUMPTION

At Tiny Riots, we remind parents of the importance of being present during their children's mealtimes, ensuring responsible consumption and the wellbeing of the baby.


10. LANGUAGE

The Website, the information published on it, and the customer registration form or contract, will be drafted in Spanish and Catalan.


11. APPLICABLE LAW, JURISDICTION AND COMPETENCE

If the purchaser is a consumer, any dispute that may arise between Tiny Riots and the Customer shall be resolved before the courts and tribunals of the Customer's place of residence or the place of performance of the obligation.


12. PERSONAL DATA PROCESSING

In accordance with Regulation (EU) 2016/679 (General Data Protection Regulation) and Organic Law 3/2018 on Personal Data Protection and Digital Rights Guarantee, personal data provided through the use of the Website will be included in a database for which Tiny Riots is responsible, and which complies with the necessary technical and organisational measures to protect such data.

The processing of personal data by Tiny Riots, as well as any other information requested for access to and use of the Website, shall be governed by the provisions of Tiny Riots' Privacy Policy, available at: https://www.tinyriots.es/policies/privacy-policy
